Vague topic title but it's basically what I'm wondering.

Story:

I cooked some of the following food(shown in pic) earlier today which I made for dinner and left it on the stove for when I wanted some later. A few other people has some as well. I went back about 15 minutes ago to finish off the last bit. I heated it up then dumped the remaining in a bowl and was watching TV while finishing it up. near the last little bit I almost choked one something hard which didn't seem like food. I pull said thing out of my mouth and this is what it was.

NOTE: It's about an inch long and normal width of a wire. Pic is really zoomed in below.

A few facts though. It's not part of anything in my house. I have never seen wiring like this before and it wasn't in the pan prior to it, fell in, or put in by someone. It had to have come from the bag. I wasn't really hurt as I choked on it before I swallowed it but my throat kinda hurts but thats from the scratching of the wires which will heal fine in a day.

Now what I want to know is do I have a case and what should I do at this point? I know a few BG'ers might know the best way to go about it at this point.

Not everything is about money either. Even if I don't get a dime I would rather them check their packaging plant so something else doesn't fall in there that actually gets someone hurt.

If you're serious about the suit, you'll take your own pictures and see hope that you can get some sort of record. Otherwise, it'll probably be a difficult case since (I assume) you were alone at the time of the incident and there is no evidence of injury.

This x100. Quit being a bitch, you have a tiny scratch, you are not hurt, stop crying. If your intent is to prevent this from happening, call the damn company and let them know so they can investigate. Don't try to sue them and try to make a buck......

You should watch "Hot Coffee", it's about the myth of the massive plaintiff suites and screwing the system that has been perpetrated by big business to get the average Joe to blame plaintifs rather than companies that are liable. There are FAR less frivolous lawsuits than people are led to believe, as they don't make it past the initial stages without being of merit.

As for the OP: Coming from the wife of someone who just started lawschool (and thus knows nothing about law yet) - You can't recover damages if you're undamaged. You can however send a letter and the wire, and they will most likely send you a coupon and apology.

Honestly -- Simply informing them might grant you a good chunk of stuff, too. They may give you free shits. Maybe not, but I really wouldn't be surprised.

I'd say since your injuries are -extremely- minor and you've already washed off the wire and eaten the evidence, you're better off just writing the company a letter saying something along the lines of "Hey this wire was in my soup you should check your shit." and maybe include the bag it came in and the wire. Having the bag would let them know where it was packaged and whatnot.

Edit (Guess I'll give some actual advice): On a serious note your case is pathetic. You've already destroyed any credibility you might have had with this post. You stated there were other people there that touched it, you left it unattended (with other people around too) prior to getting the alleged scratchy soup and you stated you had no injuries of a substantial nature. They would just say "prove to me without a doubt that it came from the factory like that." Answer: You can't. One of the other people could have put it there being dicks or it could have fallen in on accident without you noticing it. Lawyers are fucking amazing at destroying credibility and poking holes in stories. They can make things sound like they aren't at fault even if they are; it is there job after all.

You could probably threaten them with legal action and get some free soup mix or something if you wanted to be a dick, but really that stuff needs to be saved for people who are actually injured badly. Every frivolous case makes serious cases have that much harder of a time. Everyone automatically assumes if you sue someone for personal injury your just trying to get free shit even if it's a very serious injury that isn't the persons fault because people always try to sue for every little thing. I would at least notify them of it though so they can work to prevent such things (even if they didn't do it and somehow else it happened it won't hurt them to be extra careful lol).

Personal injury lawsuits only allow you to recover expenses. You are not very injured. Pain and suffering damage are usually in extreme cases. Since you are not injured, this wouldn't qualify.

It is likely that punitive damages would be the only award worth your time, that's when the court punishes the company by awarding you. You'd have to prove that this shit ended up in your soup because of the company's recklessness and indifference to safety.

As for the "think of the children" line, something like that isn't likely to be common... I would wager that yours is the only bag to ever go out with something like that in it, and probably will be for a long time.

As people have said, write/call/email them and tell em what happened, and I would recommend not being a belligerent douchebag about it. If you come off sounding like you're trying to get something out of it, they'll probably think you're lying just to get free shit and say "Prove it" (as I well know from years in the restaurant industry). However, if you just write to inform them of what happened and word it like you're looking out for their best interest, they'll be thankful/apologetic instead of defensive and you'll probably get free shit.

Not a lot of people realize how much free shit you can get by calling those comments/feedback numbers and basically being quality control for them. Even if it's just a 2-litre of pop that's kinda' flat, or your drive-thru order at Taco Bell that was screwed up... let alone a jagged, metal, foreign object in your soup mix.
