The Court is currently hearing arguments for Proposition 8 (California's gay marriage ban that was overturned by an Appeals Court) and The Defense of Marriage Act (the Federal government's refusal to recognize gay marriages regardless of what states do) in the most historic civil rights case in decades.
during oral arguments more or less everything is falling into place though Chief Justice Roberts has been strangely silent and Sotomayor is proving herself more cautious than one would hope more a liberal justice. Kagan did not end up having to recuse herself and Anthony Kennedy is acting like Anthony Kennedy and arguing both sides of the cases at once.
while it would be ideal to see gay marriage legalized throughout the land it is unlikely + even a smaller ruling extending marriage equality to 38 million Californians (or more than 1/10th of the United States) and providing federal benefits to same-sex couples would be a historic victory for the cause
