Facebook's New Terms Of Service: "We Can Do Anything We Want With Your Content. Forever."

Facebook's terms of service (TOS) used to say that when you closed an account on their network, any rights they claimed to the original content you uploaded would expire. Not anymore.

Now, anything you upload to Facebook can be used by Facebook in any way they deem fit, forever, no matter what you do later. Want to close your account? Good for you, but Facebook still has the right to do whatever it wants with your old content. They can even sublicense it if they want.

You hereby grant Facebook an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to (a) use, copy, publish, stream, store, retain, publicly perform or display, transmit, scan, reformat, modify, edit, frame, translate, excerpt, adapt, create derivative works and distribute (through multiple tiers), any User Content you (i) Post on or in connection with the Facebook Service or the promotion thereof subject only to your privacy settings or (ii) enable a user to Post, including by offering a Share Link on your website and (b) to use your name, likeness and image for any purpose, including commercial or advertising, each of (a) and (b) on or in connection with the Facebook Service or the promotion thereof.

That language is the same as in the old TOS, but there was an important couple of lines at the end of that section that have been removed:

You may remove your User Content from the Site at any time. If you choose to remove your User Content, the license granted above will automatically expire, however you acknowledge that the Company may retain archived copies of your User Content.

Furthermore, the "Termination" section near the end of the TOs states:

The following sections will survive any termination of your use of the Facebook Service: Prohibited Conduct, User Content, Your Privacy Practices, Gift Credits, Ownership; Proprietary Rights, Licenses, Submissions, User Disputes; Complaints, Indemnity, General Disclaimers, Limitation on Liability, Termination and Changes to the Facebook Service, Arbitration, Governing Law; Venue and Jurisdiction and Other.

Make sure you never upload anything you don't feel comfortable giving away forever, because it's Facebook's now.

Oh, you also agree to arbitration, naturally. Have fun with that.

Ya, I totally agree, Facebook was wicked back a few years ago when it was only College/University students. I liked the concept of networking with your friends across the country at different schools, and meeting new people that you go to school with. Opening it up to literally everyone and their mothers was a horrible idea, and went downhill fast. All those requests drive me absolutely fucking crazy and now it's just a huge money maker with bullshit ads everywhere.

It's the potential of it that makes so bad. I know a lot of friends who are photographers and such semi-professionally who could get shafted by this.

If you upload it and they own it they likely can use it without permission and are free to sell/reproduce without even mentioning the creator.

That said I'm surprised it took this long. I believe anything uploaded to MySpace belongs to NewsCorp ever since they took over or some such.

Highly unlikely. Most ToS have a clause that they can change it at any moment with no notice.

Who here uploads as many photos/adds as many apps/adds as many friends/etc as possible?

Otherwise, I found Facebook to be another MMORPG for some people, except the elitists are the ones with 5000+ photos, 10000+ friends and the BIGGEST "my profile" page ever, that kind of thing. And has to comment on every fucking comment, photo, and whatnot. EVERYTHING.

As we probably mentioned before on another thread, I use Facebook to somewhat keep in touch with a few people, and perv over the people I used to know but don't really talk to anymore (god some of those girls are hot since school! haha), and somewhat keep track of what my other families are doing.

However, I -DO- get sick of the people that:

- Change their profile pic every 6~ hours
- Change their status every 20 mins (i.e. xxx is bored. xxx is bored, again! xxx thinks: fuck this world!)
- Change their status to attention whore (just in: Amanda is alone, AGAIN!!!! -- followed by 4-5 comments)
- Change their status via MOBILE (i.e. xxx is at work! xxx is on the train! xxx is stuck in traffic! -- followed by more attention whoring)
- Upload 60-120 photos of their "night" out which is the same as the previous 50 nights out. Generally you looking like a complete twat in an attempt to social proof yourself.

The application thing seems to have died down in recent times, so I'll skip over that.

In regards to the ToS stuff, I don't mind. It was somewhat inevitable.

I do update my status from time to time, never w/ inane shit like alot of people do, usually with a WTF moment from BSG/hilarious political youtube clip/news article.

My friend and I were laughing at the whole 25 things meme that was all over facebook recently and how nobody in our generation has any notion of privacy, and how we are all sketchy voyeur preverts. In general though if you aren't an idiot the way most users on FB are, its pretty easy to avoid getting stupid shit of you posted/avoid having people you don't want seeing stupid shit of you posted. Also, facebook was nicer when it was just college kids.
