Edit3: Also if its peer to peer transfer and there is no way to prove it... Then how come there was an article about a guy getting caught for downloading music and movies off of limewire? They set traps and trace where the packets are going even on limewire and other p2p networks!
You can 'scrape' torrents to get the list of people on it, how long they've connected, how much they've transferred, etc. and then connect to them to figure out what client they're using. They're just using a slightly modified client, logging onto a suspected torrent, and having it capture all of the normal data, then crossreferencing it with their logs from the system they have in place that assigns network addresses to figure out who you are.
You can get 'caught' on limewire in one of two ways. They could set up their client to share a file with the rest of the world, in effect, becoming illegal content distributors themselves, and logging who tries to get it. Or, they could just search LimeWire to see who has what, download and inspect the content, and then you're caught that way.
