    Better have her signed that sex consent form from now on...

    just read this in Time Magazine,

    the Maryland case, which was tried in 2004. The accuser and the defendant agree that after he began to penetrate her and she wanted him to stop, he did so within a matter of seconds and did not climax. Even so, during deliberations, the jury sent a note to the judge asking if it was rape if a female changed her mind during the sex to which she consented and the man continued until climax. The judge said it was for them to decide. They convicted the defendant of first-degree rape, among other sex offenses.


    which means, if you are doing something your partner doens't like during intercourse and she withdraws her consent, you could be convicted as a rapist, subsequently serving a couple years in prison and tossing some other dude's salad involuntarily.

    If a woman changes her mind during, that's fine. Disappointing sure, but fine nonetheless. You should stop.

    But that guy stopped "within seconds". How can that be rape? Reaction time in itself is a few seconds...

    If a girl says no and you continue it is rape, even if it is just a few seconds. HOWEVER that doesn't mean he deserves to go to prison or have a criminal record.

    This is a slap in the face for any real rape victim and just dilutes real justice.

    It couldn't of been THAT bad because she wanted to have sex in the first place. The amount of pain/harm done to her can not be compared to a real rape victim who was assaulted by someone in a situation she had 0% control over. The experience might of been unpleasant for her but there is no way it was traumatic(at least not for a normal person anyway).

    Does the punishment fit the crime? A few seconds of her displeasure is worth a life time of him being branded a sex offender, denial of future job options, public shame, and oh ya.. years in prison?

    Furthermore you have to evaluate the criminal. In Oklahoma we talk a lot about jury nullification, which basically means we have the right to return a not-guilty verdict in any situation for whatever reason we want.

    Basically it is a belief that unless the person is a danger to society they don't belong in prison, period. I wouldn't be afraid to live next door to this guy or have him spend time at my house. You can't begin to compare this guy to someone who found a victim, planned an assault, and carried it through start to finish.

    With jury nullification the state not only has to prove a law was broken, but that it is just and the world is better off with the person behind bars.

    See, this is fucking bullshit right here. The only "damage" she recieved from that incident was her OWN regret. Him penetrating her was consented by her as stated below. How a jury ignored this and called him guilty of rape is beyond me...
